McCormack Law Firm Files Discrimination and Wage Violation Lawsuit Against Apria Healthcare LLC and Affiliates

Sacramento, California – McCormack Law Firm has filed a comprehensive lawsuit on behalf of Jhalil King against Apria Healthcare LLC, MSI Health Solutions LLC, and Adonia Logistics LLC. The suit alleges a series of severe and systemic violations under the Fair Employment and Housing Act (FEHA), as well as multiple infractions of the California Labor Code.

Jhalil King, a former medical courier for the defendants, asserts in the lawsuit that during his employment, he experienced racial discrimination and harassment, including an incident where a co-worker affixed a racist drawing to his equipment, and a separate occasion where his manager made racially offensive gestures in his presence.

Despite multiple complaints, King contends that the defendants failed to address these actions, leading to a hostile work environment. The complaint further alleges that the defendants exhibited retaliatory behavior, culminating in the unlawful termination of King’s employment following his objections to discriminatory treatment and wage violations.

The lawsuit details King’s allegations of being misclassified as an independent contractor while fulfilling the role of an employee. According to the complaint, King was required to work on-call without compensation and was not reimbursed for necessary business-related expenses, including vehicle and phone use. The lack of proper payment for overtime, minimum wage violations, and denial of mandated rest periods are also among the grievances listed.

Attorney Bryan McCormack, of McCormack Law Firm in San Francisco, is pursuing justice for Mr. King with a demand for a jury trial, seeking compensatory and punitive damages, as well as restitution for wage theft, penalties, and legal costs. The filing also includes a call for systemic changes within the defendant companies to prevent further discriminatory and retaliatory practices.

This lawsuit serves as a reminder that all companies, regardless of their size or industry, are subject to state and federal labor laws designed to protect employees from unjust treatment and to ensure fair compensation for their work.
